RETURNS, REFUNDS & CONSUMER GUARANTEES POLICY

Our Commitment
E-Mega is committed to meeting its obligations under New Zealand consumer law.
Nothing in this policy limits your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986.
Change-of-Mind Returns
E-Mega is not legally required to provide a refund or exchange simply because a customer:
- changes their mind;
- chooses the wrong product;
- no longer requires a product;
- finds a cheaper alternative elsewhere.
Unless E-Mega expressly agrees otherwise, change-of-mind returns are not accepted.
This does not affect your rights where goods fail to meet applicable consumer guarantees.
NZ Consumer Protection confirms that businesses generally do not have to provide refunds or exchanges simply because a customer changes their mind.
Faulty Products
If a product purchased from E-Mega does not meet the guarantees required under applicable New Zealand consumer law, please contact us.
Depending on the circumstances and seriousness of the problem, remedies may include:
- repair;
- replacement;
- refund;
- compensation for qualifying loss.
The appropriate legal remedy depends on the nature of the failure.
Our Right to Assess a Product
E-Mega may reasonably inspect, diagnose or test a product before determining:
- whether a fault exists;
- the likely cause of the fault;
- whether a consumer guarantee has been breached;
- the appropriate remedy.
Consumer Protection specifically recommends that businesses investigate complaints before determining what remedy, if any, is appropriate.
Diagnostic Charges
Where testing establishes that a problem was not caused by a breach of a consumer guarantee—for example where it resulted from misuse, accident, unauthorised modification or customer-caused damage—a reasonable diagnostic fee may apply where that fee was disclosed before assessment.
No diagnostic charge will be used to prevent a customer from exercising valid statutory rights.
Manufacturer Warranty Periods
A manufacturer's warranty period does not replace or limit statutory consumer rights.
A consumer may still have rights after a manufacturer's stated warranty expires depending on the circumstances.
Customer-Caused Damage
A remedy may not be available where the problem was caused by matters including:
- misuse;
- impact or accident;
- unauthorised modification;
- use contrary to manufacturer instructions;
- inappropriate charging equipment;
- work performed by another person that caused the fault;
- damage occurring after delivery.
Each claim will be assessed individually.
Used, Demonstration and Clearance Products
Where E-Mega sells used or demonstration goods in trade, applicable statutory guarantees will be considered in light of factors including the item's:
- age;
- price;
- disclosed condition;
- previous use;
- faults expressly disclosed before purchase.
A customer cannot reasonably expect a used product to have the same condition as an equivalent new product, but applicable consumer guarantees are not automatically removed merely because goods are second-hand.
Proof of Purchase
E-Mega may request reasonable evidence that the product was purchased from us, such as:
- receipt;
- invoice;
- order confirmation;
- bank or card record;
- other reasonable evidence of purchase.
Return Transport
Please contact E-Mega before sending a product back.
Where E-Mega has a legal obligation to provide a remedy, transport and return arrangements will be handled consistently with applicable New Zealand law.
Do not courier potentially unsafe lithium batteries without first contacting us.
