Oric Holding T/A E-Mega operates in trade in New Zealand and supplies electric bikes, electric scooters, parts, accessories, servicing, repairs, diagnostics and battery-related services.

E-Mega clearly operates in trade for the purposes of New Zealand consumer law. Online traders must make their trader status clear where customers can purchase goods or services.

2. Acceptance of These Terms

By purchasing goods or services from E-Mega, placing an order through our website, booking workshop work or otherwise engaging E-Mega to provide services, you agree to these Terms and any applicable Returns, Shipping, Workshop or Battery Service policies.

Nothing in these Terms limits or excludes any rights or remedies that cannot lawfully be limited or excluded under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable New Zealand law. Consumer guarantees apply independently of store or manufacturer warranties.

3. Prices

Unless otherwise stated:

  • prices are in New Zealand dollars;
  • GST is included where applicable;
  • freight, delivery, installation or other additional charges may be shown separately.

We take reasonable steps to ensure pricing is accurate.

If an obvious pricing, description or system error occurs, E-Mega may contact you before supply and give you the opportunity to proceed at the correct price or cancel the affected order.

4. Product Information

E-Mega takes reasonable care to ensure product descriptions, specifications, photographs and other product information are accurate.

Colours and appearance may vary slightly because of photography, screen settings, lighting or manufacturer changes.

Manufacturers may change specifications from time to time. Where we become aware of a material change affecting your order, we will endeavour to advise you before supply.

Nothing in this section limits E-Mega's legal obligations concerning product descriptions or representations.

5. Orders and Availability

All orders are subject to availability.

E-Mega may decline or cancel an order where reasonably necessary, including where:

  • stock is unavailable;
  • an obvious pricing or listing error has occurred;
  • payment cannot be authorised;
  • fraud or unlawful activity is reasonably suspected;
  • E-Mega cannot lawfully or safely supply the product.

If E-Mega cancels an order after receiving payment and the relevant goods or services have not been supplied, the amount paid for that cancelled portion will be refunded.

6. Payment

Payment must be made through one of the payment methods accepted by E-Mega.

Workshop and repair invoices are payable in accordance with the booking, quote, job record or invoice.

7. Consumer Guarantees

Goods and services supplied to consumers are subject to applicable New Zealand consumer guarantees.

Goods supplied by a trader must meet applicable guarantees concerning matters such as acceptable quality, safety, durability, fitness for purpose and correspondence with description.

Services must be provided with reasonable care and skill, be fit for an agreed purpose, be completed within a reasonable time where no timeframe has been agreed, and be charged at a reasonable price where the price has not previously been agreed.

8. Manufacturer Warranties

Some products may carry a manufacturer's warranty.

Where appropriate, E-Mega may assist customers with legitimate warranty claims for products purchased from E-Mega.

A manufacturer's warranty is additional to and does not replace rights a consumer may have under New Zealand law.

9. Appropriate Use

Customers must use electric bikes, electric scooters, batteries, chargers and accessories in accordance with:

  • manufacturer instructions;
  • relevant safety requirements;
  • applicable New Zealand law;
  • instructions supplied by E-Mega.

Where a fault or damage was caused by misuse, unauthorised modification, accident or failure to follow appropriate instructions, this may affect whether a remedy is available. The CGA does not require a remedy where customer misuse or alteration caused the problem.

10. Third-Party Products

Some products supplied by E-Mega are manufactured by third parties.

Where E-Mega sells those products directly to a consumer, the existence of a manufacturer or distributor does not remove E-Mega's responsibilities as retailer where New Zealand consumer law applies.

11. Website Availability

E-Mega aims to maintain accurate and available website services but does not guarantee uninterrupted access.

The website may occasionally be unavailable for maintenance, security or technical reasons.

12. Intellectual Property

Unless otherwise stated, E-Mega website content, including original text, photographs, graphics, logos and branding, is owned by or licensed to E-Mega.

Content must not be reproduced for commercial purposes without permission except where permitted by law.

13. Business-to-Business Transactions

Where goods or services are acquired for genuine business purposes, E-Mega and another business may separately agree in writing to contract out of specified provisions of consumer legislation where New Zealand law allows this and the statutory requirements are satisfied.

For the Fair Trading Act, contracting out is restricted to qualifying transactions between parties in trade, must be in writing and must be fair and reasonable.

No consumer transaction is intended to be contracted out of consumer legislation by these general website Terms.

14. Changes to These Terms

E-Mega may update these Terms from time to time.

The version applying to a transaction will ordinarily be the version in effect when that transaction was entered into, unless otherwise required by law.

These Terms are governed by New Zealand law.
